The gaming rights for the Lord of the Rings and the Hobbit belong to Middle-Earth Enterprises (former Tolkien enterprises) that currently have a licensing agreement with Warner Bros. The first BFME, released in 2004, was made based solely on the Peter Jackson's movies, while BFME 2 was a by-product of EA's acquisition of also the gaming rights for the books from 2005 until 2010 (allowing them to expand on the LOTR universe the way they did). Unfortunately, no just like they could not continue running the servers for the BFME games, EA are not able to sell it in any way without reacquiring the rights for LOTR for both the films and the books.
